Said petition requests termination of your parental rights in and to A.J.W., a minor child; and requests the adoption of said child by Robert D. Kubik. You must appear at the time and place set forth above to show cause, if any you have, why your parental rights in and to A.J.W., a minor child should not be terminated and why said child should not be adopted by Robert D. Kubik, and the prayer of said Petition granted.

NOTICE

BRIEFING
Carey Deaver, Human Resources Director, introduced Matt Walz, CEO of Face It!. Face It! is a community-wide initiative promoting awareness and long-term recovery for persons struggling with chemical dependency. Mr. Walz detailed the program strategy which utilizes support through a network of service providers. The program is funded through employers and others benefiting from the program.
AGREEMENT
The Sioux Empire Fair Association requested that their current 1 year management agreement, which expires on 12/31/10, be replaced with a five year term. Ron Wieman, SEFA Chairman, thanked the Commission for their support over the past year. Steve Munk, Extension Educator and SEFA Board Member, gave a presentation on changes in the practices of the SEFA since falling victim to embezzlement last year. The SEFA is requesting the extension in term to allow them to enter into long term contracts and to obtain other financing. Progress to date includes improved cash flow, board restructuring, and strategic planning. Tryg Fredrickson, Sioux Empire Fair CEO, reported on total Fair debt amounting to $576,987.92, which includes $245,000 for the Expo ice. Commissioner Pekas commented that although this year's fair was successful, the overall debt remains staggering. Mr. Munk reported that the SEFA is looking at whether their current events are revenue generating as well as family friendly. Year-round events were also looked at and found to generate enough revenue to support their cost. Commissioner Twedt discussed the need for infrastructure/venue change and strategic planning for the future, with the involvement of the Commission and other interested parties. Commissioner Hajek commented that County funding of the Fair is to be used for capital improvements, not operational costs. Mr. Munk stated that he was not aware of the funding clause and that the SEFA would like to become financially stable and not have to come to the County. MOTION by Kelly, seconded by Barth to authorize the Chairman to sign a 5-year Management Agreement with the Sioux Empire Fair Association. There is no guarantee of funding in the agreement. Commissioner Hajek asked that the SEFA keep the Commission informed of their financial status throughout the year. Commissioners Pekas and Twedt felt the request was premature. VOTE on the motion. 3 ayes, Twedt and Pekas nay. The agreement will be valid from 1/1/10 to 12/31/14 and contains the following provisions: 1) nothing precludes the County from selling the existing fairgrounds property during the term of this agreement and requires that a two year written notice be given; 2) the County agrees that it may appropriate funds in an amount determined during the budgeting process for maintenance and improvements of the property and the expense of conducting the annual fair, and 3) any long-term financing secured by the Association from a third-party shall be the sole obligation of the Association and that the County shall have no obligation to repay such financing.
At the request of Bill Hoskins, Museum Director, MOTION by Barth, seconded by Twedt to authorize the Chairman to sign the 2010 Lease Agreements with the Sioux Valley Genealogical Society and the Minnehaha County Historical Society for space in the Old Courthouse Museum. 5 ayes.
GRANT
On 11/17/09, Hugh Grogan, Human Services Director, reported on a federal grant opportunity through the Neighborhood Stabilization Program. Today, he requested authorization to apply for a grant in the amount of $1.5 million. The grant funds must be used for construction purposes. If awarded, the money will be used to supplement the construction of the new Safe Home/Housing First facility to be located at the northeast corner of 3rd Street and Minnesota Avenue in Sioux Falls. Notice of award should be made by mid-December. Applications for funding are accepted monthly. Commissioner Twedt commented on the need to move forward with this project and to continue to look at every available funding opportunity. MOTION by Twedt, seconded by Hajek to authorize the submission of the NSP Grant application and authorize the Chairman to sign the required notice of intent letter to Sioux Falls Mayor Munson. 4 ayes, Kelly - nay.
MOTION by Twedt, seconded by Barth to adjourn into Executive Session for contract negotiation. 5 ayes. Following the Executive Session, the Commission adjourned until 9:00 a.m. on Tuesday, December 1, 2009.

NOTICE TO BIDDERS
Sealed bids will be received at the Office of the Minnehaha County Auditor, 415 N. Dakota Ave., Sioux Falls, South Dakota, 57104, until 10:30 A.M., on the 14th day of December, 2009, at which time all bids will be publicly opened, read, and considered by the Minnehaha County Board of Commissioners. By virtue of statutory authority, a resident bidder is allowed a preference as against the bid of any bidder from any other state enforcing or having preference for resident bidders, equal to such preference.
All bids shall be made on forms prepared by the Minnehaha County Highway Department. Any bids otherwise submitted will be deemed informal, irregular, and not subject to or worthy of consideration in the award of the contract.

The proposal guaranty required, which must accompany each proposal is a certified check, cashier's check, or a bank draft, issued upon a National or State bank domiciled within the State of South Dakota, in an amount equal to 5% of the amount bid, payable to the Minnehaha County Treasurer, or, a bid bond, issued by a surety company authorized to conduct business within the State of South Dakota, in the amount of 10% of the bid.
A contract may be awarded to the Company or Firm offering the most advantageous proposition to Minnehaha County. The Board of County Commissioners reserves the right to, reject any/or all bids and to waive any defect or informality if it is deemed to be in the best interests of Minnehaha County.
